1. Introduction

These Terms of Service, along with the User Agreement, constitute a legally binding agreement between Sama Travel Private Limited ("GoSama") and any individual or entity ("User") accessing or using GoSama’s services through its websites, mobile applications, or other sales channels. By using GoSama’s services, the User agrees to comply with these Terms of Service.

2. Eligibility

Users must be at least 18 years old and possess the legal authority to enter into this agreement. Minors (below 18 years) may use the services only under the supervision of a parent or legal guardian. GoSama reserves the right to terminate any account if it discovers that the User is underage or otherwise incompetent to contract.

3. Use of the Website

Users agree to use the website only for lawful purposes and in accordance with these terms. GoSama grants a limited, non-transferable, and revocable right to access and use the website for personal and non-commercial purposes.

Prohibited Activities:

Distributing, exchanging, modifying, selling, or transmitting any content from the website for business or commercial purposes.

Hosting, displaying, uploading, publishing, or transmitting any information that is unlawful, defamatory, obscene, or infringes intellectual property rights.

GoSama reserves the right to terminate access to the website without notice for any User found engaging in prohibited activities.

4. Content and Intellectual Property

All content provided through GoSama’s sales channels, including text, images, logos, and software, is owned by GoSama or licensed to it and is protected by applicable intellectual property laws. Users are prohibited from using this content for any purpose other than as explicitly allowed by GoSama.

5. Booking Policies

a. General Booking Terms

GoSama acts as a facilitator for bookings made with third-party service providers, including airlines, hotels, bus operators, and other travel-related services. The contract of service for the booked product lies between the User and the respective service provider.

b. Cancellations and Refunds

Cancellations are subject to the terms and conditions of the respective service provider.

Refunds will be processed as per the policies of the service provider and GoSama.

Convenience fees charged by GoSama are non-refundable.

6. Payment Terms

Users must ensure that all payments are made only to authorized GoSama accounts. GoSama will not be responsible for any payments made to unauthorized accounts or individuals. Payment modes include credit/debit cards, net banking, UPI, wallets, and other options displayed on the website.

Short Payments

In case of underpayment due to technical or other errors, GoSama reserves the right to recover the balance amount from the User.

Taxes and Charges

Any changes in taxes or levies imposed by the government will be passed on to the User. Such changes may occur without prior notice.

7. Travel Documents and Visa Requirements

Users are responsible for ensuring that they have valid travel documents, including passports and visas, for their trips. GoSama will not be liable for any issues arising from incomplete or incorrect documentation.

8. Privacy Policy

Users are advised to review GoSama’s Privacy Policy, which outlines how personal information is collected, used, and protected.

9. Limitation of Liability

GoSama’s role is limited to facilitating bookings and transactions between the User and the service provider. GoSama will not be liable for:

Any deficiency in services provided by the service provider.

Loss, injury, or damages resulting from the use of services.

Errors, delays, or cancellations by service providers.

10. Indemnification

The User agrees to indemnify and hold GoSama harmless from any claims, damages, or losses arising out of:

Breach of these terms by the User.

Violation of any law or third-party rights.

11. Force Majeure

GoSama shall not be liable for any failure or delay in providing services due to circumstances beyond its reasonable control, including natural disasters, strikes, pandemics, government actions, or technical issues.

12. Grievance Redressal

Users may escalate unresolved complaints to GoSama’s Grievance Officer. Contact details of the Grievance Officer are available on the website. GoSama endeavors to resolve complaints within 30 days.

13. Amendments

GoSama reserves the right to modify these Terms of Service at any time. Users are advised to regularly review the terms to stay updated.

ADM (Agency Debit Memo) Policy

Any ADM arising due to the below mentioned reasons will have to be borne by the Travel Partner.

  • System Misuse
  • Fictitious Names or Fake Name Like Test Names / Wrong Names
  • Duplicate Bookings
  • Churning for same segment / Flight / Date
  • Hold Bookings must be released or issued before Time Limit to avoid Agent Debit Memo (A DM)
  • In Case the Booking is aborted at the time of Hold or Booking - Please do not issue tickets multiple times, Please contact our call centre for further action - ADM's will be borne by the agent if not guided by this policy.

14. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to arbitration in Ernakulam, with exclusive jurisdiction of courts in Ernakulam.
